Management taking notes of my restroom time.

So I have IBS with ulcers, testing for crohns and/or colitis is ongoing. But I have accomodations from my specialist saying I need to be able to use the restroom whenever I need to, etc. We have hour by hour sheets we have to fill out every day to report the work that has been done and management wants me to write down every time I use the restroom and for how long, is this legal? I'm in Minnesota.

  1. Hi , I'm so sorry you're dealing with this request from your employer. While I don't have any personal experience with such issues, I did a quick Google search and found these resources: https://www.govdocs.com/can-employer-legally-monitor-time-spend-bathroom/, https://neathousepartners.com/toilet-breaks-at-work/ and https://blog.axcethr.com/long-bathroom-breaks. I also found this reddit discussion about a similar issue: https://www.reddit.com/r/AskReddit/comments/f3z43/is_it_legal_for_an_employer_to_track_and_publish/. From what I've read, it sounds like they should pay you for the time you spend in the bathroom anyway, so I don't see why they need to know how long you use it for... Could you talk to them about how uncomfortable it makes you to write down the duration of your bathroom use, so that you can find another solution together with your management?
I really hope that you'll be able to figure something out together, this sounds like a very uncomfortable situation. 🙁
Sending positive thoughts, Karina (team member)
